When drafting employment contracts, there are a number of regulations that employers must observe and comply with, such as the German Act on Evidence (“Nachweisgesetz” = “NachwG”) or Sections 305 ff of the German Civil Code. We use our expertise to support our clients in drawing up legally compliant employment contracts as the basis for their employment relationships. With the exception of small businesses, the Dismissal Protection Act (“Kuendigungsschutzgesetz” = “KSchG”), which places high demands on the effectiveness of dismissals, generally applies to the termination of employment relationships.

We support our clients in the preparation and enforcement of dismissals and also in the drafting and negotiation of cancellation agreements. We advise our clients on the relevant aspects of individual law and their relationship to collective rights and obligations in the run-up to transfers of undertakings. We accompany our clients through the entire process of the transfer of business, including the preparation of information letters to the employees.
